Hennepin County Court Information

The first courthouse in Hennepin County was built in 1857. The second courthouse, the Minneapolis City Hall and Hennepin County Courthouse was designed in 1888 and completed in 1895. The third and current courthouse was completed in 1974. The Hennepin County Courthouse is the most common location for court cases, although other locations may be used.

County Clerk

There is no County Clerk or Clerk of Court office for Hennepin County. Instead, judicial districts are managed by the Chief Judge, Assistant Chief Judge, and Judicial District Administrator.

United States District Court

Hennepin County is part of the District of Minnesota for the United States District Court. The Minneapolis division includes Blue Earth, Anoka, Brown, Chippewa, Carver, Faribault, Hennepin, Freeborn, and Isanti Counties.

Patrick J. Schiltz is the Chief United States District Judge. Kate M. Fogerty is the Clerk of Court.

District Court

Hennepin County is part of the 4th judicial district in Minnesota. There are 10 judicial districts in the state. The District Court includes criminal cases, civil actions, violations of city ordinances and traffic offenses, probate, family cases, and juvenile cases. Civil Court also includes a Conciliation Division for small claims cases up to $15,000.

The District Court also hears appeals from the Conciliation Court.

Referees

A court referee is a judicial officer that has been given the authority to hear the parties and their testimony in specific cases and report back to the court. Usually, referees are also allowed to dispose of cases that are not contested.

Civil Court

Civil courts hear cases that are not criminal in nature and usually involve a financial or property dispute between two people.

The Civil Court division of the 4th Judicial District hears cases involving civil lawsuits and contracts, conciliation (Small Claims), housing foreclosures and evictions, and other non-criminal judgments.

Criminal Court

Criminal Court has two locations in downtown Minneapolis and two suburban locations. This court has jurisdiction over all criminal cases, and it also includes Treatment Courts, such as Drug Court and Veterans Court.

Probate Court

Probate Court and Mental Health Court are combined in Hennepin County. Probate Court hears cases that involve wills, trusts, conservatorships, guardianships, and property of deceased people.

Mental Health Court is used for the legal process of committing people to treatment centers for care of mental disorders, addiction, and developmental disabilities.

Family Court

The Family Division hears cases regarding domestic relations. This includes things like name changes, divorce, custody, paternity, domestic abuse, and child/spousal support.

Juvenile Court

This court hears cases involving delinquency, dependency, and emancipation of those under age 18. Delinquency refers to criminal offenses. Dependency refers to truancy or cases where a child has been neglected or abused. Adoption cases are also heard in Juvenile Court.

Veterans Court

Veterans Court is a specialty court designed to help veterans with mental health issues and/or substance abuse problems resulting from their military service. The program is 12-18 months long and includes partnerships with Veterans Affairs, mentors, and other veterans’ services the county offers.

Drug Court

Drug Court is a voluntary program that is designed to be at least 12 months long. It offers intensive treatment for substance abuse and includes social services, treatment specialists, and other supporting services.
